Today, following a coordinated European investigation, the Consumer Protection Cooperation (CPC) network of national consumer protection authorities and the European Commission notified Temu, the online marketplace, of several practices on its platform that violate EU consumer law. The CPC network has instructed Temu to bring these practices into compliance with European Union consumer protection regulations. Temu is still under investigation and has been asked to provide additional information to the network.
The CPC investigation covers a broad range of practices faced by consumers when shopping on Temu, including those that may mislead consumers or unduly influence their purchasing decisions. The network is also examining whether Temu is meeting the specific information obligations that online marketplaces must adhere to under EU consumer law.
Temu now has one month to respond to the CPC’s findings and propose commitments on how it will address the identified consumer law issues. Depending on Temu’s response, the CPC network may initiate further discussions with the company. If Temu fails to address the concerns raised by the network, national authorities can take enforcement actions to ensure compliance. This may include the imposition of fines based on Temu’s annual turnover in the relevant member states.
