
Albuquerque, NM — The New Mexico Department of Justice (NMDOJ) has stepped in to stop a local subcontractor, Boreworxx Construction, LLC, from enforcing nearly $2 million in unlawful property liens against almost 200 homeowners in Albuquerque.
The company, led by Jeffery Dailey, is accused of filing these liens as a means of pressure during a contract dispute with Circet USA, a company managing fiber-optic infrastructure improvements in city-owned rights of way. Boreworxx was contracted to carry out fiber installation work but did not receive full payment from Circet after the work was allegedly found to be unsatisfactory.
As per the NMDOJ investigation, Boreworxx tried to intimidate homeowners into lodging complaints with Circet in an effort to obtain payment. The state concluded that the liens were filed illegally and were intended to scare residents and manipulate them for leverage.
Attorney General Raúl Torrez condemned the move: “We will not tolerate abusive scare tactics or unethical behavior by businesses in this community. Homeowners should never be used as bargaining chips in a private contract dispute.”
As part of a formal Assurance of Discontinuance (AOD) agreement, Dailey and Boreworxx have agreed to:
Release all previously filed liens;
- Cease all future lien filings related to this dispute;
- Stop contacting homeowners who received lien-related notices;
- Provide the NMDOJ with a list of all individuals affected;
- Preserve all relevant documents and records.
The NMDOJ has confirmed that homeowners who are affected will receive official notification regarding the removal of any lien on their property.
