
Atom Tickets, a popular online ticketing platform, has agreed to pay a $550,000 settlement to resolve a proposed class action lawsuit that accused the company of failing to disclose service fees to consumers in a timely manner. The lawsuit claimed that Atom Tickets violated New York’s Arts and Cultural Affairs Law by not clearly presenting service fees before customers completed their ticket purchases.
The settlement, which was preliminarily approved by the court on December 10, 2024, covers all U.S. residents who, between August 29, 2022, and April 30, 2024, paid service fees for electronic tickets to theaters in New York state through AtomTickets.com, the Atom Tickets mobile app, or any other online platform operated by the company.
Settlement Details
Class members who are eligible can submit claims to receive a pro-rated share of the $550,000 settlement fund. The amount each person will receive will depend on the total service fees they paid during the specified period. To file a claim, affected individuals must submit a valid claim form online or by mail by June 23, 2025.
The settlement website, AtomTicketsFeeSettlement.com, offers two ways to submit claims. Online claimants can log in using their unique ID and PIN found in the settlement notice emailed to them on February 6, 2025. Those who did not receive the notice or have lost their credentials are encouraged to contact the settlement administrator for assistance. Alternatively, a PDF claim form can be downloaded and mailed.
Settlement payouts will be made in the form of a check or through electronic payment options such as PayPal, Zelle, or Venmo. If you choose the check option, it will expire 180 days after it is issued.
As part of the settlement, Atom Tickets has agreed to modify the purchase flow on its website and mobile app for New York state theaters to ensure full compliance with state law. Specifically, Atom Tickets will now disclose all fees, including service charges, before customers finalize their ticket purchase. This change is designed to give consumers a clearer picture of the total ticket cost, as required by New York’s Arts and Cultural Affairs Law.

A final approval hearing for the settlement is scheduled for May 5, 2025. If the court approves the deal, settlement payouts are expected to be distributed 90 days after the judgment becomes final.
For consumers who believe they are part of the class but have not yet received notice, it’s important to act soon to file a claim. The deadline for submitting claims is fast approaching, and those who fail to submit a valid claim form by June 23, 2025, will not be eligible for compensation.
